§ 15-2-9. Land Disturbing Activities Subject to Stormwater Runoff Control.

  • Unless otherwise exempted by Section 15-2-3, a stormwater control permit under Section 15-2-15 shall be required and all stormwater management provisions of this Chapter shall apply, to any of the following activities within the areas described below:

    (a)

    New Development: Any development(s) commenced after August 22, 2001 that result(s) in the addition of twenty thousand (20,000) square feet or more of impervious surface to the site; or, arises from the development of a previously developed or partially developed site(s) and results in a new site(s) condition with a total cumulative addition of twenty thousand (20,000) square feet of impervious surface.

    (b)

    Any development that requires a subdivision plat, as defined in applicable local land division ordinance(s).

    (c)

    Any development that requires a certified survey map, as defined in the applicable local land division ordinances(s); for property intended for commercial or industrial use.

    (d)

    Redevelopment as defined in Section 15-2-4.

    (e)

    If after review by the Public Works Committee it is determined that the runoff from the land disturbing activity will create a hazard by exceeding the safe capacity of the receiving water body or storm sewer in the area; or will cause undue channel erosion or an undue increase in water pollution by increased scour and transport of particles; or will otherwise endanger the downstream property owners or their property; or will significantly impact a lake, stream, or wetland area. Safe capacity is defined as the rate of flow that can be handled without flooding.

    (f)

    The owner, land occupier or land user shall be in compliance with this Chapter if he follows the procedure of Section 15-2-10 and receives from the City Engineer approval of the control plan and a permit before commencement of any land disturbing activities on lands subject to control under this Section.
