§ 15-2-12. Off-Site Stormwater Management.

The City may establish off-site stormwater management and associated fees, provided that provisions are made to manage stormwater by an off-site facility, and provided that all of the following conditions for the off-site facility are met:

(a)

The facility is in place;

(b)

The facility is designed and adequately sized to provide a level of stormwater control that at least meets the City's ordinance standards;

(c)

The City is satisfied that the facility has a legally obligated entity responsible for its long-term operation and maintenance.
