§ 14-1-37. Procedures and Criteria for Land Divisions Within the Extraterritorial Plat Approval Jurisdiction.

  • (a)

    Statement of Purpose. This section shall govern the division of lands lying within the extraterritorial plat approval jurisdiction of the City in adjoining towns pursuant to Sections 236.02(5), 236.10(1), and 236.45(3), Wis. Stats. The purpose of this section is to promote the public health, safety and general welfare of the City and the lands within its extraterritorial plat approval jurisdiction. The City of Verona and Town of Verona adopted an Intergovernmental Agreement (VIGA) on June 20, 2016. Pursuant the adopted the VIGA, the City and the Town desire a well-planned, and compatible Town and City border.

    (b)

    Application Required. No person, firm or corporation shall divide any land located within the extraterritorial plat approval jurisdiction of the City of Verona without first filing an application and the proposed plat or certified survey map with the Town and the City for recommended action by the Joint Planning Committee (JPC) and final action by the Common Council.

    (c)

    Pre-Application Procedure.

    (1)

    Before filing an application for approval of the plat or certified survey map, the subdivider shall consult jointly with the City and Town staff and shall:

    a.

    Prepare a preliminary sketch for review and approval.

    b.

    Complete an Environmental Assessment Checklist.

    (2)

    This procedure will assist the subdivider in appraising the objectives of these regulations, the Master Plans, the Official Maps, and other applicable City and/or Town regulations.

    (3)

    The pre-application information shall be submitted to City and Town staff at least twenty-one (21) days prior to when the application is to be considered.

    (d)

    Land Division Procedure. For land divisions by plat and certified survey map, the procedure for action by the JPC shall be as specified in the VIGA, and the JPC shall make recommendations to the Common Council for final action.

    (e)

    Review Standards. Land divisions shall be reviewed per the requirements and standards established within the VIGA.

    (f)

    Exceptions. On a case-by-case basis, the JPC may recommend approval of land divisions to the Common Council that are inconsistent with the VIGA, so long as the land division promotes the City's Comprehensive Plan, does not impede potential City growth, and promotes the health, safety, welfare and morals of both the City and the Town. The Common Council shall consider the JPC's recommendation and take action.
