§ 10-1-28. Large Vehicle and Trailer Parking.

  • (a)

    Definitions. Large vehicles shall be defined as follows:

    (1)

    For the purpose of this Section, a Type 1 large vehicle means a mechanically or electrically powered device that can be used to transport people or cargo, including, but not limited to, a truck, truck power unit, tractor, bus, recreational vehicle, or boat, and that meets any of the following criteria:

    a.

    Has a weight of more than twelve thousand (12,000) pounds; or

    b.

    Has an overall length of greater than twenty-two (22) feet (including accessories, racks, other physical extensions, devices or attached appurtenances); or

    Note: A typical large SUV is approximately nineteen (19) feet, a typical dually pickup approximately twenty-one (21) feet.

    c.

    Has an enclosed area with a height of more than eight (8) feet from the surface upon which it is located.

    (2)

    For the purpose of this Section, a Type 2 vehicle means a nonmechanically or nonelectronically powered device that can be used to transport people or cargo, including, but not limited to, all types of trailers, regardless of size and/or cargo type. Examples include, but are not limited to, a semi trailer; a trailer for a boat, watercraft, snowmobile, ATV/UTV, or motorcycle, including when the cargo is on the trailer; a utility trailer; a landscape trailer; and a camper. When attached to a Type 1 large vehicle, a Type 2 large vehicle becomes an extension, devise or appurtenance of the Type 1 large vehicle and the rules governing Type 1 large vehicles apply.

    (3)

    Park or parking means the halting of a Type 1 or Type 2 large vehicle, whether occupied or not, except the lawful temporary halting of such large vehicle upon any street, avenue or public way in the City for the actual loading or unloading of goods, ware, merchandise or passengers, provided however that the loading or unloading shall be limited to the actual time consumed in such operation.

    (b)

    Street parking.

    (1)

    Except as provided in Subsection (b)(2) and (3), no person owning or having control of a Type 1 or Type 2 large vehicle shall park such large vehicle:

    a.

    Upon any street, avenue or public way located in the City between the hours of 7:00 p.m. to 6:00 a.m.

    b.

    Upon any street, avenue or public way located in the City for more than two (2) hours between the hours of 6:00 a.m. and 7:00 p.m.

    (2)

    Parking prohibited at all times. When signs are erected giving notice thereof, no person owning or having control of a Type 1 or Type 2 large vehicle shall park such large vehicle at any time on the following portions of streets in the City of Verona:

    a.

    Verona Avenue between Lincoln Street and Nine Mound Road.

    b.

    South Main Street between Verona Avenue and Park Lane.

    (3)

    Exceptions:

    a.

    Type 2 large vehicles may be parked upon any street, avenue or public way located in the City except for those areas listed in Subsection (b)(2) for more than two (2) hours between the hours of 6:00 a.m. and 7:00 p.m. on weekdays if the primary function of the Type 2 large vehicles is for the transport or storage of materials or tools related to construction activity.

    b.

    The Common Council may designate specific truck parking zones.

    c.

    The Chief of Police may approve temporary street parking rules.

    (c)

    Parking on Private Property. It is permissible to park on private property a Type 1 or Type 2 large vehicle under the following conditions:

    (1)

    As permitted by Section 13-1-285 of this Code.

    (d)

    Removal. Any Type 1 or Type 2 large vehicle unlawfully parked under this section may be removed from the street by order of a law enforcement officer, pursuant to Section 10-1-32, and the expense of moving and storing such large vehicle shall be paid by the operator or owner of the large vehicle as a forfeiture, in addition to the penalties prescribed in this Chapter.
